4. PRODUCT ORDERING & SALES TERMS

4.1 Order Process

How to Order:

  2. Add items to shopping cart
  3. Review cart and proceed to checkout
  4. Provide delivery and payment information
  5. Review order summary
  6. Click "Place Order" or "Complete Purchase"

Order Submission = Offer: When you place an order, you are making an offer to purchase products subject to these Terms.

Order Acceptance:

  • We accept your offer by sending an Order Confirmation email
  • A binding contract is formed when we dispatch your order
  • We reserve the right to decline orders before dispatch

Order Confirmation Email: You will receive an email confirming:

  • Slight variations in measurements (±1-2 cm) are normal
  • Handcrafted items may have minor imperfections (these are not defects)

  • We provide detailed size charts for most products
  • Measurements are approximate
  • Check size chart before ordering

Product Availability:

  • Stock levels are indicative only
  • We reserve the right to cancel orders if stock runs out after order placement
  • Discontinued products may be removed without notice

4.4 Pricing & Payment

4.4.1 Currency & Display

Dynamic Pricing:

  • Prices display in the currency appropriate to your region:
    • UK customers: GBP (£)
    • EU customers: EUR (€) or GBP (£)
    • India customers: INR (₹)
    • Rest of World: USD ($) or GBP (£)

Inclusive of:

  • Product price
  • Applicable taxes (VAT for UK/EU, GST for India)
  • Shipping costs (displayed at checkout)

Exchange Rates:

  • If paying in a different currency than displayed, your bank's exchange rate applies
  • We are not responsible for exchange rate fluctuations or bank conversion fees

4.4.2 Taxes

UK/EU Customers:

  • Prices include UK VAT (20%) where applicable
  • Exports outside UK may be zero-rated for VAT
  • You may be responsible for import duties in your country (if not DDP)

India Customers:

  • Prices include Indian GST as applicable
  • For DDP shipments from UK, customs duties are prepaid by us (no extra charges at delivery)

Rest of World:

  • Prices may or may not include local taxes depending on your country
  • You may be responsible for import duties, customs fees, or taxes upon delivery (if not DDP)
  • Check with your local customs authority

4.4.3 Payment Methods

  • PayPal

  • Razorpay (India customers)
  • Bank Transfer (by arrangement only)

Payment Processing:

  • UK/EU/ROW customers: Payments processed by Taro Designs UK Ltd via Stripe, PayPal, or other UK-based processors
  • India customers: Payments processed by Karee Clothing Private Limited via Razorpay or other India-based processors

Payment Security:

  • We do NOT store your full credit card details
  • Payments are processed by PCI-DSS compliant processors
  • We use SSL encryption for secure transmission

Payment Authorisation:

  • Payment is authorised at checkout
  • Funds are captured when order is dispatched
  • Pre-authorisation may appear on your statement before dispatch

Payment Failures:

  • Orders will not be processed if payment fails
  • You will be notified by email
  • You may update payment method and retry

Fraudulent Payments:

  • We use fraud detection systems
  • Suspicious orders may be flagged and require verification
  • We may request ID, proof of address, or contact you by phone
  • We reserve the right to cancel orders suspected of fraud

4.4.4 Pricing Errors

If we discover a pricing error:

  • We will contact you before dispatch
  • You may:
    • Accept the correct price and proceed, OR
    • Cancel the order for a full refund

We are NOT obligated to honor incorrectly priced products.

Common pricing errors include:

  • Missing decimal point (e.g., £5 instead of £50)
  • Currency errors
  • System glitches
  • Promotional code stacking errors

4.5 Promotional Codes & Discounts

Use of Codes:

  • Enter promotional codes at checkout
  • Codes are case-sensitive
  • One code per order (unless stated otherwise)
  • Codes may have expiry dates, minimum order values, or product exclusions

Code Abuse:

  • Creating multiple accounts to reuse single-use codes is prohibited
  • Selling or transferring codes is prohibited
  • We may cancel orders using fraudulently obtained codes

Discounts:

  • Sale prices are as marked on the Website
  • Discounts apply to product price only (not shipping, unless stated)
  • We reserve the right to end promotions at any time

5. SHIPPING & DELIVERY

5.1 Delivery Locations

We deliver to:

  • United Kingdom (all addresses including Northern Ireland, Scottish Highlands, islands - may incur surcharges)
  • India (all serviceable pin codes)
  • European Union (all member states)
  • Select international countries (check at checkout)

We do NOT deliver to:

  • P.O. Boxes (except where explicitly allowed)
  • Military addresses (APO/FPO)
  • Countries under trade sanctions
  • Certain remote islands or territories (will be indicated at checkout)

5.2 Delivery Timeframes

Estimated delivery times from dispatch:

Important Notes:

  • Timeframes are estimates only, NOT guarantees
  • Delays may occur due to customs, weather, carrier issues, high-demand periods (e.g., Diwali, Christmas)
  • Processing time (1-3 business days) is additional
  • Delivery to remote areas may take longer

We are NOT liable for delivery delays beyond our reasonable control.

5.3 Shipping Costs

Calculated at checkout based on:

  • Destination country
  • Order weight/value
  • Delivery speed (standard vs. express)

Free Shipping Offers:

  • May apply for orders above certain thresholds (e.g., UK orders over £50)
  • Promotional terms apply (check Website for current offers)
  • Free shipping usually applies to standard delivery only

5.4 International Delivery - DDP Model (India & Select Countries)

Delivered Duty Paid (DDP) Explained:

For customers in India and select other countries, we use a DDP (Delivered Duty Paid) shipping model:

We pay:

  • All import customs duties
  • All taxes (GST, VAT, etc.)
  • Customs clearance fees
  • Brokerage fees

You pay:

  • Product price
  • Shipping fee (if applicable)
  • NO additional charges at delivery

How DDP Works for India:

  1. Bulk Shipment:

    • We may consolidate multiple India orders into one bulk shipment for efficiency
    • Shipped from UK to India warehouse
  2. Customs Clearance:

    • We clear customs and pay all duties/GST on behalf of all customers in the bulk shipment
    • Goods are imported under Taro Designs UK Ltd / Karee Clothing Private Limited
  3. Local Distribution:

    • After customs clearance, Karee Clothing Private Limited receives the goods
    • Individual orders are then packaged and dispatched to customers within India
    • Delivered by local couriers (BlueDart, DTDC, Delhivery, etc.)
  4. What This Means for You:

    • Faster delivery (no individual customs delays)
    • No surprise charges at delivery
    • Environmentally efficient (fewer flights)

CRITICAL: Refused Delivery Under DDP

Because we prepay duties and taxes, you MUST accept delivery.

If you refuse delivery or ask courier to "Return to Sender":

  • We lose the prepaid customs duties and GST (non-refundable from government)
  • Return shipping costs apply
  • Your refund will be reduced by: Duties + GST + Clearance Fees + Return Shipping

What to do instead:

  1. Accept the delivery (even if you're unsure)
  2. Inspect the items at home
  3. Request a return within 7 days if needed (following our Returns Policy)

Exception: You may refuse delivery if packaging is visibly damaged or courier behaves inappropriately. Contact us immediately in such cases.

5.5 Delivery Process

Carrier Responsibility:

  • Once handed to carrier, delivery is their responsibility
  • We work with reputable carriers but cannot control their operations

Tracking:

  • You will receive a tracking number by email once order ships
  • Track via carrier website or tracking link provided

Delivery Attempts:

  • Carriers typically make 2-3 delivery attempts
  • If delivery fails, item may be returned to sender
  • Check tracking for re-delivery options or pickup location

Signature Required:

  • Some shipments (high-value, international) may require signature
  • If no one is available, carrier will leave a notice with pickup/re-delivery instructions

Safe Place / Neighbour Delivery:

  • You may authorize carrier to leave at safe place or with neighbor (at your risk)
  • We are not liable for theft or damage after delivery to authorized location

Incorrect Address:

  • You are responsible for providing a complete, accurate delivery address
  • We are not liable for failed deliveries due to incorrect addresses
  • Re-delivery fees may apply if address correction required

5.6 Failed Deliveries & Unclaimed Packages

If you do not collect your package:

  • It will be returned to sender after carrier's hold period (typically 7-14 days)
  • You may be charged for return shipping costs
  • Original shipping fee is non-refundable
  • Refund (minus shipping costs) will be issued once package returns to us

Abandoned Orders: If you ignore delivery attempts and do not contact us or carrier, we may treat the order as abandoned and retain payment to cover our losses.

5.7 Customs Inspections

For international shipments (even DDP):

  • Customs authorities may open and inspect packages
  • We cannot prevent this
  • If customs damages packaging, this is beyond our control
  • If product itself is damaged by customs, contact us with proof (customs inspection notice)

6. RETURNS, REFUNDS & CANCELLATIONS

Quick Summary:

6.1 UK & EU Customers

Statutory Rights:

  • 14 days to notify us of cancellation (from receipt of goods)
  • Additional 14 days to return (28 days total from receipt)
  • Full refund including standard delivery cost (if you paid for it)
  • You pay return shipping (unless item is faulty)

Conditions:

  • Item must be in resalable condition (substantially unused)
  • Tags must be attached
  • Refund may be reduced if item excessively handled or damaged

6.2 India Customers

Voluntary 7-Day Policy:

  • 7 days from delivery to request return
  • Strict eligibility criteria (completely unworn, all tags intact, photo pre-approval required)
  • You pay return shipping
  • Refund after inspection (product price only, shipping non-refundable)

India-specific requirements:

  • Email photos before shipping return
  • Wait for Return Authorization Number (RAN)
  • Items shipped without approval will be rejected

6.3 Rest of World Customers

7-Day Voluntary Policy:

  • Same as India (7 days, strict criteria, customer pays return shipping)

6.4 Non-Returnable Items (All Customers)

  • Underwear (bras, panties, shapewear)
  • Swimwear
  • Pierced earrings
  • Beauty/cosmetics
  • Items marked "Final Sale"
  • Gift cards
  • Customized/personalized items

6.5 Defective or Wrong Items

We will replace or refund if:

  • Item arrives damaged
  • Item is defective (manufacturing fault)
  • Wrong item sent

Process:

  1. Email returns@kareeclothing.com (UK/EU/ROW) or returns.india@kareeclothing.com (India)
  2. Within 7 days (India) or 14 days (UK/EU/ROW) of delivery
  3. Include photos of defect/damage
  4. We provide prepaid return label OR replacement

6.6 Pre-Dispatch Cancellations

Before order is dispatched:

  • Contact us ASAP at contact@kareeclothing.com
  • If not yet shipped, we will cancel and refund fully
  • If already shipped, standard return process applies

After dispatch:

  • You cannot cancel
  • Standard return process applies once delivered

7. WARRANTIES & LIABILITY

7.1 Statutory Consumer Rights

Nothing in these Terms affects your statutory rights, including:

UK/EU Customers:

  • Consumer Rights Act 2015 (UK)
  • Consumer Rights Directive 2011/83/EU
  • Goods must be as described, fit for purpose, of satisfactory quality
  • Right to repair, replacement, or refund for faulty goods (within 6 years UK, 2 years EU)

India Customers:

  • Consumer Protection Act 2019
  • Sale of Goods Act 1930
  • Right to replacement or refund for defective goods
  • Right to file consumer complaint

Rest of World: You retain all consumer rights granted by your local laws.

7.2 Product Warranties

Implied Warranties: We warrant that products:

  • Conform to descriptions on our Website
  • Are free from manufacturing defects
  • Are fit for their intended purpose

Warranty Period:

  • 6 months from delivery (unless local law provides longer period)

Warranty Claims: Email contact@kareeclothing.com with:

  • Order number
  • Photos of defect
  • Description of issue

Warranty Does NOT Cover:

  • Normal wear and tear
  • Damage from misuse, abuse, or neglect
  • Alterations or modifications
  • Improper care (e.g., washing at wrong temperature)
  • Accidental damage
  • Color fading from excessive sun exposure

7.3 Limitation of Liability

To the maximum extent permitted by law:

We are NOT liable for:

  • Indirect, consequential, or incidental losses (e.g., loss of profits, business, data)
  • Losses arising from your breach of these Terms
  • Losses caused by third parties (carriers, payment processors, etc.)
  • Delays due to events beyond our reasonable control (see Section 7.5)
  • Minor color variations or size discrepancies
  • Website downtime or errors

Our maximum liability to you is limited to:

  • The amount you paid for the product(s) in question, OR
  • £100 / ₹10,000 (whichever is lower)

Exceptions (we remain liable for):

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory rights that cannot be excluded by law
  • Defective products under Consumer Protection Act (UK/India)

7.4 Your Responsibilities

You are responsible for:

  • Providing accurate order information
  • Ensuring delivery address is correct and accessible
  • Checking goods upon delivery
  • Following care instructions for products
  • Notifying us promptly of defects or issues
  • Complying with these Terms

7.5 Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including:

  • Natural disasters (floods, earthquakes, fires, storms)
  • War, terrorism, riots, civil unrest
  • Government actions, laws, regulations
  • Strikes, labor disputes
  • Pandemics, epidemics
  • Supplier failures
  • Power outages, internet failures
  • Carrier/logistics disruptions
  • Customs delays or blockages

In such events:

  • Our obligations are suspended for the duration
  • We will notify you as soon as reasonably possible
  • We will resume performance when the event ends
  • If delay exceeds 30 days, either party may cancel the order for a refund

8. INTELLECTUAL PROPERTY & RESTRICTIONS

8.1 Trademarks

The following are trademarks owned by us:

  • Karee Clothing

You may NOT:

  • Use our trademarks in business names, domain names, social media handles, or product listings
  • Create products using our trademarks
  • Imply affiliation or endorsement without written permission

8.2 Product Designs

Our clothing designs are protected by:

  • Copyright (artistic works)
  • Design rights (registered or unregistered)
  • Potentially patents or trade dress

Counterfeiting & Imitation:

  • Creating knockoffs or replicas of our designs is illegal
  • Selling counterfeit Karee products is illegal
  • We will pursue legal action against counterfeiters

If you discover counterfeit products: Please report to contact@kareeclothing.com with details.

8.3 Website Content

All Website content is protected by copyright:

  • Product photos
  • Descriptions
  • Blog posts
  • Videos
  • Graphics

You may NOT:

  • Use our images on your own website/social media for commercial purposes
  • Copy descriptions for resale purposes
  • Scrape or download bulk content

Limited Permission:

  • You may share product images on personal social media with proper attribution (@kareeclothing, link to our site)
  • You may review our products using our images (fair use)
